TERMS AND CONDITIONS OF SALE
These Terms and Conditions of Sale (“Terms”) govern all purchases made through www.avarofiglio.com (the “Site”) operated by Avaro Figlio S.R.L. (the “Company,” “we,” “us,” or “our”). Please read these Terms carefully before placing an order. By confirming an order, you (the “Customer” or “you”) confirm that you have read, understood, and accepted these Terms in full.
1. The Company
Avaro Figlio S.R.L., with registered office at Via Pietrasanta 12, 20141 Milano, Italy, VAT number 13276150961, trading as Maison Avaro Figlio Milano.
2. Products
All products sold on the Site are luxury made-to-order couture garments and accessories, produced individually to the Customer’s specifications. Product descriptions, images, colours, and measurements are provided for guidance only; slight variations may occur due to the handcrafted and artisanal nature of our production. Such variations are not considered defects.
3. Orders
Orders placed through the Site constitute an offer to purchase. An order becomes binding only when we send an Order Confirmation to the email address you have provided. We reserve the right to refuse or cancel any order at our sole discretion, including (but not limited to) cases of suspected fraud, incorrect pricing, product unavailability, or non-compliance with these Terms.
4. Prices and Payment
All prices shown on the Site are in Euros (€) and include VAT where applicable. Prices do not include shipping costs, customs duties, or import taxes for deliveries outside the European Union, which are the Customer’s responsibility.
We reserve the right to change prices at any time. Price changes will not affect orders already confirmed by us.
Payment must be made in full at the time of placing the order via the payment methods available on the Site. We do not store full card details; payment data is processed securely by our payment providers.
5. Made-to-Order Production and Delivery Timeframes
Because each garment is made to order and produced individually, production times typically range between 4 and 8 weeks from the date of Order Confirmation, depending on the piece and current atelier schedule. Estimated delivery times will be communicated in your Order Confirmation. These are indicative and may vary due to fabric availability, customisation complexity, or events beyond our reasonable control.

6. Right of Withdrawal — Important Notice for Made-to-Order Goods
Under Article 59(1)(c) of the EU Consumer Rights Directive 2011/83/EU, as implemented in Italy by Article 59 of the Consumer Code (Codice del Consumo, D.Lgs. 206/2005), consumers do not have the right to withdraw from contracts for the supply of goods made to the consumer’s specifications or clearly personalised.
As all Avaro Figlio products are made to order and produced to the Customer’s individual specifications (including measurements, colour, fabric, and customisation details), they are exempt from the statutory 14-day right of withdrawal. Orders cannot be cancelled once production has begun.

7. Defective or Non-Conforming Products
In accordance with Articles 128–135 of the Italian Consumer Code, consumers are entitled to legal remedies in the event that a product is defective or does not conform to the contract. Please refer to our Shipping and Return Policy for the procedure to follow.
8. Intellectual Property
The AVARO FIGLIO trademark, the MAISON AVARO FIGLIO MILANO name, together with all figurative marks, logos, distinctive signs, illustrations, images, and designs appearing on our products, accessories, packaging, and the Site — whether registered or not — are and shall remain the exclusive property of Avaro Figlio S.R.L. Any total or partial reproduction, modification, or use of such marks or content, for any reason and by any means, without our prior written consent, is strictly prohibited and will be legally pursued.
9. Force Majeure
We shall not be liable for any delay or failure to perform our obligations under these Terms caused by circumstances beyond our reasonable control, including but not limited to natural disasters, fires, floods, wars, civil unrest, strikes, acts of government, pandemics, supplier failures, or disruption to transport networks. We will notify you as promptly as possible of any such event and will resume performance as soon as reasonably practicable. If the disruption continues for more than two (2) weeks, you will have the right to cancel the affected order and obtain a refund, except where production of a made-to-order piece has already been completed.
10. Limitation of Liability
Our liability to Customers is limited to the purchase price of the product. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
11. Data Protection
Personal data provided in connection with your order is processed in accordance with our Privacy Policy, available on the Site.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Italian Republic. For disputes involving consumers, the courts of the consumer’s place of residence or domicile in Italy or another EU Member State shall have jurisdiction, in accordance with applicable consumer protection laws. For all other disputes, the Court of Milan shall have exclusive jurisdiction.
Consumers resident in the EU may also use the European Commission’s Online Dispute Resolution platform, available at https://ec.europa.eu/consumers/odr.
