TERMS AND CONDITIONS OF SALE
These Terms and Conditions of Sale ("Conditions") apply to purchases made through our Site. Please read these Conditions carefully before placing an Order. By confirming that you have read and accepted these Conditions when placing an Order through our Site, you confirm that you accept them unconditionally.

Capitalized words, used in these Terms, have the meaning established in the "Definitions" section. These Conditions, together with your Order Confirmation, constitute the contract between the parties concerning the purchase of the Products and to which other different terms or conditions will not apply. The contract can only be modified as a result of a reciprocal agreement reported in writing or by e-mail.
A copy of these Conditions may be stored electronically or printed by all users of the Site.
INFORMATION RELATING TO PRODUCTS
We make every reasonable effort to ensure that the information relating to the Products is accurate and up-to-date. Any content on the Site should not be construed as a representation or binding declaration relating to the Products. All images, illustrations and descriptions of the Products are for indicative purposes only and, since the colors you may actually see on our Site depend on your monitor, we cannot guarantee that the colors your monitor displays reflect the colors correctly. of the products we will deliver to you. HOW TO PLACE AN ORDER
To place an Order you must be at least 18 years old. To place an Order you must select the Products on the Site, select the delivery method you prefer and, at your choice, any optional services and select the "PROCEED TO CHECKOUT" command. Before completing the verification procedure (check-out) you will be asked to log in with your personal account or, alternatively (if you are not yet registered), to register a new one. If you prefer, you can complete the verification procedure (check-out) without registering, but you will be asked to enter your personal and payment details, necessary to execute the Order.
We will not accept Orders placed in ways other than those described above. Orders will be processed and Products delivered only if we consider the Order complete. An Order is considered complete if all the requested information has been correctly entered and these Conditions have been accepted.

When you place an Order, you make an offer to purchase the Products you have selected. Orders are subject to the availability of the Products and are subject to our approval. We may not accept your Order, at any time and at our discretion, if:
• You have provided incorrect information, such as, for example, incorrect or insufficient payment details, incorrect billing details; incorrect or incomplete shipping address or misleading information;
• There is an error on the Site relating to the Products you have ordered, for example an error relating to the price or description of the Products; or
• The Products you have ordered are no longer available for sale through the Site;
• We believe you are not of legal age.
We will not be liable to you or to any third party for the withdrawal from the Site of any Product, for the removal or modification of the materials or contents of the Site, for the refusal to execute an Order or for the suspension of the transaction. once the management of the same has begun for each of the above reasons.
If it is not possible to accept your Order, we will contact you by e-mail or telephone as soon as possible, in any case no later than 30 (thirty) days from the date of your Order. If it is not possible to accept or process your Order because the Products are no longer available or due to an error relating to prices and / or other information relating to the Products you have ordered, we will contact you and suggest alternative products that may be of your choice and you may want to buy. If you do not accept our suggestions, we will cancel your Order for Products that we cannot provide you and we will refund you the sums you have already paid for these Products within 14 (fourteen) days of the Order.
If you have placed the Order through the Site, you will receive an e-mail with which we confirm that we have received your Order and which contains the details relating to the same (such as, for example, the quantity of Products purchased, the price, the terms delivery). This e-mail does NOT represent acceptance of your Order. Unless you cancel your Order, the Order will be shipped. At this time you will receive an Order Shipping Confirmation e-mail to inform you that we have shipped all or part of the Products you have ordered.
Orders can be canceled at any time before being taken over by the Company. If you wish to cancel your Order, please contact us using the contacts in the Contact section. We will not accept cancellations of Orders placed in ways other than those identified above. Once your Order has been managed, you can only exercise your right of withdrawal according to the procedure described below.
WHAT HAPPENS IF THE PRODUCTS ARE NOT AVAILABLE
We make every reasonable effort to ensure that the information relating to the Products on the Site is always accurate. However, when you place an Order, certain Products may not be available.
If it is not possible to send you the Products ordered within 30 (thirty) days from the date of your Order, we will contact you and ask you if you intend to cancel your Order in whole or in part and, in this case, we will refund all the sums paid. for the Products included in the canceled Order. If we do not receive a reply to the e-mail or voice message that we may have left you, we will send you an e-mail to notify you. If you do not contact us within 3 days of this last communication, we will cancel your entire Order and refund the price of the Products. None of the conditions contained therein in any way reduces your binding rights in relation to defective products or products that do not conform to the products purchased. OUR PRICE POLICY
The prices of the Products are indicated on the Site and will be confirmed in the Order Confirmation that we will send you by e-mail.
All prices are in Euros and include VAT.
It is possible that shipping costs may be applied to your Order as indicated on the Site at the time you place the Order. Shipping costs will depend on the value of your Order and the shipping method you have chosen. You can view the rates and delivery conditions by clicking here.
We reserve the right to change the price of the Products on the Site at any time and without notice. Changes to the price of the Products will not affect your Order that has already been accepted by the Company and for which we have already sent you the Order Shipping Confirmation.
If we detect an error in the price of the Products you have ordered, we will notify you as soon as possible by email or telephone and we will offer you the choice of reconfirming your Order at the correct price or canceling your Order. If you cancel the Order, we will refund or re-credit the amount you have incurred for the Products whose Order you have canceled.
HOW CAN I MAKE THE PAYMENT
You can pay for the Products using a credit or debit card. We accept the main payment card circuits, such as Visa, Master Card. Payment is made in the currency indicated in your Order before sending.
If you pay by credit or debit card, at the time of the Order you will need to provide your card details, which will be charged, when we receive your Order, for an amount equal to the total value of your Order. We will not accept your Order, nor will we send the Products, until the issuer of your credit or debit card has authorized the transaction for the payment of the Products ordered. We will notify you immediately if we do not receive this authorization. We reserve the right to verify the identity of the credit or debit card holder by requesting the most appropriate information.
When paying via PayPal, you will be asked to log into your account with your email and password to confirm the payment. If you do not have a PayPal account, you can still pay via PayPal and you will be asked to enter your personal data and credit card details. The Products will be sent to you after the completion of the payment transaction. If we do not receive payment within 30 days from the date of your Order, your Order will be canceled and you will receive an e-mail confirming the cancellation of the Order.
The Products will be shipped to the address specified in the Order Confirmation. In any case, we can only send documents by e-mail to the address you provided us at the time of the Order.
WHEN THE PRODUCTS ARE SHIPPED AND HOW CAN I TRACK THE STATUS OF MY ORDER
The shipment will take place, at your choice, by ordinary courier or express during office hours. Shipping costs may apply to your Order. We will not proceed with the shipment of the Products unless we have received payment. If someone is not available who can receive the Products delivered to the delivery address indicated, we will notify you by means of a notification left by the courier in your mailbox.
The ownership and the risk of loss of the Products will be transferred to you upon delivery

HOW TO RETURN PRODUCTS

YOUR RIGHT OF WITHDRAWAL
If you have received the ordered Products and you are not satisfied or you have simply changed your mind about the purchase after we have sent you your Order Shipping Confirmation by e-mail, you can exercise your right of withdrawal without penalty and without indicating any reason and request a refund, pursuant to articles 64 and following of Legislative Decree 206/2005 ("Consumer Code").
Please consider that as long as the Products remain in your possession, you have the obligation to keep them safe and in good condition.
After informing us of your decision to withdraw from the Contract, we will refund you as soon as possible, and in any case no later than 14 days from the date on which you exercised your right of withdrawal, any sum you have incurred or charged to you on the credit card for the Products ordered.
TREATMENT OF PERSONAL DATA
The AVARO FIGLIO brand, as well as all trademarks, whether figurative or otherwise, and all other distinctive signs, illustrations, images and logos that appear on our products, accessories or packaging, whether registered or not, are and remain exclusive property of AVARO FIGLIO. Any total or partial reproduction, any modification or use of such trademarks, illustrations, images and logos, for any reason and by any means, without our prior written consent, is strictly prohibited and will be prosecuted.
We use all reasonable efforts to fulfill our obligations under these Terms. However, we will not be liable for delays or non-performance if such delays or omissions are caused by circumstances beyond our reasonable control including, without limitation, natural disaster, explosion, flood, fire or accident; wars or civil unrest; strikes, trade union unrest or work stoppages; any form of government intervention; action or omission committed by a third party; default by our suppliers; errors in the delivery address or failure to notify relevant changes, or failure to pay.
We will notify you of any unforeseen event as soon as possible after it occurs and we will fulfill our obligations as soon as possible. If this interruption exceeds 2 (two) weeks, you will have the right to cancel the Order and a refund will be made in accordance with Article 9 of these Conditions.
These Conditions are governed by Italian law (including, by way of example, articles 50 to 61 of Legislative Decree 206/2005 - Consumer Code - on distance contracts). The rules on conflict of laws do not apply. Within the limits permitted by applicable consumer protection laws, any action or dispute relating to these Conditions will be the exclusive jurisdiction of the Court of your residence or domicile, if located in Italy.

Contract: Indicates the contract between the parties for the sale and purchase of the Products and includes your Order, the Order Confirmation relating to your Order and these Conditions;
Products: Indicates the products we sell from time to time through the Site including, by way of example, clothing, footwear, bags, day bags, etc;
Order: Indicates an order for Products placed in accordance with these Conditions;
Order Shipping Confirmation: Indicates the order confirmation, which shows the acceptance of your Order and the details of the Products you have purchased, which we send you when the Products are shipped;
